I. DEFINITIONS:

1. Shore Iceland: Refers to IRDA ehf, a tourism specialist providing various services including sightseeing tours, day tours, holiday packages, tailor-made travel services, airport transfers, pick-up and drop-off services.

2. Services: Include all offerings provided by Shore Iceland as mentioned above, encompassing sightseeing tours, day tours, holiday packages, tailor-made travel services, airport transfers, pick-up and drop-off services, and any other related tourism services provided by Shore Iceland.

3. Booking: The act of reserving and purchasing services through the website https://shoreiceland.com or any other affiliated sites operated by Shore Iceland. This includes selecting desired tours, specifying dates, providing payment information, and completing the transaction process to secure the requested services.

4. Website/Sites: Refers to https://shoreiceland.com and any other websites through which Shore Iceland provides its services. These sites serve as the online platforms where users can access information about available tours, make bookings, and engage with Shore Iceland’s offerings and content.

II. TERMS FOR THE WEBSITE https://shoreiceland.com

When using our website or affiliated sites to book your tours and services, we kindly ask that you comply with Icelandic laws and regulations. Additionally, please ensure that all information provided during the booking process is accurate and truthful.

1. Compliance with Laws and Regulations: Users are required to adhere to all applicable Icelandic laws and regulations while using the services provided by Shore Iceland.

2. Acceptance of Terms: By using the website or services provided by Shore Iceland, users are legally bound by both the Privacy Policy and the Terms & Conditions outlined herein.

3. Content Standards: Users agree not to post or upload any content that is offensive, hateful, harmful, or otherwise inappropriate. This includes but is not limited to content that promotes discrimination, violence, or illegal activities.

4. Privacy Protection: Users must not collect, store, or distribute personal information of others without their explicit consent. This includes sensitive data such as names, addresses, contact information, or financial details.

5. Impersonation and Misrepresentation: Users are prohibited from impersonating others or misrepresenting their identity or relationships with others. This includes creating fake accounts, pretending to be someone else, or falsely claiming affiliations.

6. Security Measures: Users agree not to engage in activities that compromise the security or integrity of the website or its users. This includes but is not limited to distributing harmful software, attempting unauthorized access, or interfering with the functionality of the website.

7. Commercial Use Restrictions: Users are not permitted to use any information obtained from the website for commercial purposes without explicit authorization from Shore Iceland. This includes but is not limited to using content, data, or resources for advertising, marketing, or resale purposes.

8. Anti-Spam Policy: Users must refrain from sending unsolicited promotional material or spam messages through the website or its associated channels. This includes bulk emails, advertisements, or other forms of unwanted communication.

9. Consequences of Violation: Shore Iceland reserves the right to take appropriate action, including but not limited to suspending or terminating user access, in cases where these terms are violated. Such actions may be taken at the discretion of Shore Iceland and without prior notice to the user.

10. Disclaimer: Shore Iceland is not liable for damages or losses related to the use of the Website. Participants undertake tours at their own risk. Shore Iceland is not liable for accidents caused by participants or unforeseeable circumstances. Participants are responsible for their health and safety during tours. While we strive to provide accurate and up-to-date information on our website, we cannot guarantee that errors or omissions will not occur. Therefore, we kindly ask for your understanding in this matter. We understand that cancellations and refunds can be a concern for travellers, especially in unpredictable situations. That’s why we’ve outlined our cancellation policy in detail to ensure transparency and clarity for you.

11. Confidentiality: Users acknowledge and agree that any confidential information or proprietary content shared by Shore Iceland, including but not limited to trade secrets, business strategies, and proprietary data, shall be treated as confidential. Users agree not to disclose, distribute, or use such confidential information for any purpose other than the intended use of the services provided by Shore Iceland.

12. Warranties: While Shore Iceland endeavors to provide accurate information, users acknowledge the possibility of inaccuracies. The website may contain inaccurate, incomplete, or out-of-date information. Shore Iceland takes no responsibility for errors or omissions in the content of the website. Shore Iceland shall not be liable for any damages relating to the use of, or reliance upon, the website or such information, features, material, or services.

III. TERMS FOR SERVICES

Once you’ve booked with us, you agree to our service terms and conditions. We want to ensure you have all the details to make your travel experience as smooth as possible.

1. Confirmation of departure times: When you book online, you will receive a confirmation by email stating departure times and the duration of the tours.

2. Duration: The estimated duration of tours as indicated on the Website and/or the Sites are standard times and can vary according to road or weather conditions.

3. Place of departure: It is your responsibility to arrive in time to check in for your tour at the place of departure as stipulated in your voucher and/or booking confirmation. Shore Iceland reserves the right to change the meeting point. Missing the pick-up and/or the tour does not entitle you to a refund of the price paid for the Services.

4. Drop-off: Drop-off is included when you book pick-up with your tour. Drop-off will be at the same location as your pick-up.

5. Baggage on board: Shore Iceland does not take responsibility for minor scratches, cuts, and dents for items that protrude from baggage, such as retractable handles, wheels, straps, etc.

6. Customer with special needs: If you have any special needs and/or requests, you should notify Shore Iceland by email as soon as possible. Foldable wheelchairs are permitted in vehicles without additional cost but must be notified in advance. Shore Iceland cannot be responsible for damages on wheelchairs or other medical assistance equipment that can occur during tours.

7. Re-boarding after stops and rest breaks: When you leave the vehicle during stops and rest breaks when on Day Tours with Shore Iceland, it is your responsibility to ensure you re-board at the scheduled departure time. If you are not coming or you come late, the vehicle will not wait for you. Shore Iceland will not give any refunds or payment if you do not board before the vehicle leaves each stop. In such an event, you will have to re-book or find alternative transport arrangements at your own expense.

8. Safety onboard the vehicles: The safety and comfort of the customers of Shore Iceland is our main goal. The fleet of Shore Iceland includes buses, minibuses, monovolumes, and 4×4 cars, of all types and sizes, all equipped with safety belts. All customers of Shore Iceland are required to use safety belts when traveling with the vehicles of Shore Iceland as stated in Icelandic law. According to Icelandic law children under 135 cm in size must sit in appropriate child safety seats secured with seatbelts anytime when a vehicle is in motion. Shore Iceland has a limited number of children’s safety car seats and infant chairs available, free of charge.

9. Clothing: Sturdy shoes and warm outdoor wear should be worn when traveling in Iceland during all seasons. Most tours include short walks and/or hikes in nature.

10. Lost & found: All luggage and personal equipment are, at all times, at your own risk. We will not be responsible whatsoever for any loss, or damage to your luggage and/or personal equipment/clothing. If you lose clothes and/or other items in your possession during your trip with us, you can contact us by sending an e-mail to info@shoreiceland.com. Shore Iceland takes no liability for damages and/or losses of items in its tour. If an item is found in our tour, Shore Iceland takes it aside and keeps it for 30 days from the date it is found. If you contact us within the time limit mentioned and the item is found, you must provide us with an address to send it to you as soon as practicable. You must pay the cost of delivering the item. If we do not have an address, we will give the item to charity and accept no liability for the item being given to charity. It is the traveller’s responsibility to look after their personal belongings.

11. Feedback & Complaints: Shore Iceland welcomes you to send a line with your feedback on our tours. If you, for some reason, are not satisfied with our Services, please contact us as soon as possible. We value your feedback and encourage you to share your thoughts and experiences with us. Your input helps us improve our services and tailor future experiences.

12. Photography & Filming: It is allowed to take photos and videos during stops on our tours. Please note that it is not allowed to fly drones during our stops as most sites do not allow drone flights. If you are using a drone, you will do it at your responsibility. We remind passengers to be considerate when taking pictures where other people might be visible.

IV. PRICES, PAYMENTS, & PROMOTIONAL CODE

1. Prices: Prices for the Services provided by Shore Iceland are in Icelandic Kronas (ISK). Shore Iceland is not responsible for currency fluctuations and/or fees (such as bank transfer fees, credit card fees, or any other fees that may be applied outside our control). All charges are made in Icelandic Krona (ISK). On shoreiceland.com you can view the prices in other currencies as well, however, these currencies are just an approximation. Currency exchange is not being followed each day, so the prices displayed on the website might not be the same as the time of the booking. Shore Iceland’s detailed excursion descriptions list all features included in each excursion, which may or may not include guide services, meals, transportation, and entrance fees.

2. Payments: There is a charge and/or fee of 5% for processing credit card payments when the services are purchased. Shore Iceland accepts all the major credit cards.

3. Promotional code: Special promotional code (“Promo Code”), when offered by Shore Iceland, must be entered on the payment page of the Website or the Sites at the time of booking. A maximum of one Promo Code per booking can be used.

V. MODIFICATION OF TERMS & CONDITIONS

Shore Iceland reserves the right to modify these terms and conditions at any time without prior notice. Any modifications will be posted on our website and will be effective immediately. Your continued use of our website and services constitutes acceptance of these modifications.

This clause grants Shore Iceland the authority to update and amend the terms and conditions governing the use of its services. It ensures that Shore Iceland can adapt to changing circumstances, legal requirements, or business needs without the necessity of prior notice to users.

By explicitly stating that modifications will be posted on the website and become effective immediately, users are informed of where to find updated terms and are deemed to have accepted these changes by continuing to use the website and its services after modifications have been made. This helps maintain transparency and ensures that users are aware of their obligations and rights under the latest version of the terms and conditions.

VI. JURISDICTION

Users consent to the exclusive jurisdiction and venue of the courts in Iceland for any disputes arising out of or relating to the use of Shore Iceland’s services or these Terms & Conditions. Any legal proceedings shall be conducted by Icelandic law, and users waive any objection to such jurisdiction or venue on grounds of inconvenience or otherwise.

This provision establishes the legal framework for resolving disputes between users and Shore Iceland. By consenting to the exclusive jurisdiction and venue of Icelandic courts, users agree that any legal actions arising from their use of Shore Iceland’s services or any disputes related to the terms and conditions will be addressed within the Icelandic legal system.

Additionally, the clause specifies that legal proceedings shall be conducted according to Icelandic law, ensuring consistency and clarity in the application of legal principles. Users waive any objections to this jurisdiction or venue, underscoring their acknowledgment and acceptance of the legal framework established by Shore Iceland.

VII. BOOKINGS, CANCELLATIONS & REFUNDS

1. Booking liability: Booking the services, whether or not by instructions from you or a 3rd party, is subject to your review and confirmation. If you don’t send us comments about your booking (the number of persons booked, timing, dates, and locations of departures) as soon as practicable before your trip, Shore Iceland doesn’t accept any liability for any errors and/or omissions in the booking confirmation and/or the services provided. You are responsible for providing Shore Iceland with the correct contact information in the event changes are made to the services you booked with us.

2. Cancellations: You can cancel your day tour up to 24 hours before the departure time of the tour and receive a refund. In this case, a processing fee of 5% percent is deducted if a booking needs to be canceled from the system and refunded (this represents our costs for charges for processing credit cards). The cancellation time is according to our local time, GMT. All cancellations must be made in writing and should be sent to info@shoreiceland.com. If you can’t send us your cancellation via email, please send a WhatsApp, SMS, or call +354 788 1888.

In case of a cancellation or change of schedule or tour by Shore Iceland, you will be notified via email/phone call. In any case of cancellation or change, you will be offered a new date, a new tour, or a full refund. Please note that other cancellation policies may apply if you have made your reservation through a travel agency or third party.

2.1 Cancellation of private tours & group tours (groups bigger than 12 passengers): You can cancel your private tour up to 48 hours before the departure time, and receive a 80% refund. No refund is given if a cancellation request is sent within less than 48 hours before the departure time of the tour.

2.2 Cancellation of private customised tours: You can cancel a private customized tour up to 48 hours before the departure time, and receive a 80% refund. A private customized tour is meant to be intended as a private tour whose itinerary has been customized and differs from the standard Shore Iceland advertised on the website; payment for these kinds of tours has been made through a payment link after a customized quotation. No refund is given if a cancellation request is sent within less than 48 hours before the departure time of the tour.

3. Refunds: Refund policies vary based on cancellation timing and are subject to Shore Iceland’s discretion. No refund is given if a tour is cancelled within less than 24 hours before the departure time of the tour. Most of the services offered on the Website and/or the Sites are refundable when cancelled up to 24 hours before departure. We hope you understand as by that time we will have already made all the arrangements for your tour and can’t give your seat out to another passenger. Refunds will be made to the credit card used to purchase tour(s), please allow 5-10 business days for the refund to appear on your bank statement. For tours purchased through travel agencies or third parties, please get in contact with your travel agency and ask for a refund after reconfirmation of the tour cancellation with our office. Please note a refund is not possible once the tour is provided and the client goes on tour.

VIII. TRAVEL INSURANCE

Individual travel insurance is not included in the quoted prices. Shore Iceland strongly recommends that all clients purchase comprehensive travel insurance in their home country before departure. This policy should cover potential contingencies, including medical expenses, trip cancellations or interruptions, lost baggage, and repatriation costs.

In the event of an emergency medical evacuation, accident, or repatriation from a tour, all related costs are the sole responsibility of the client.

Travel insurance is typically affordable but offers invaluable protection against unforeseen circumstances such as illness, delays, or the need to cancel travel plans at short notice. Shore Iceland does not assume responsibility for any loss, damage, delay, injury, or additional expenses arising from circumstances beyond our control, including (but not limited to) flight delays, weather conditions, accidents, negligence, or acts of war.

This policy aligns with Icelandic consumer protection standards, which emphasize the traveler’s responsibility to obtain appropriate coverage when participating in tours or excursions.

IX. ICELANDIC WEATHER

Icelandic weather is highly unpredictable. Shore Iceland reserves the right to alter routes, itineraries, or timetables, or to cancel tours or activities, either partially or entirely, should weather or road conditions make it necessary for the safety of clients and staff.

If severe weather or safety concerns arise during a tour, Shore Iceland may need to shorten the tour. Similarly, if a cruise ship arrives later than scheduled, the duration of the tour will be reduced accordingly to ensure passengers return to the vessel on time. In both cases, no partial refunds or compensations will be provided, as these changes fall outside the company’s control.

These measures comply with Icelandic safety regulations and the standard duty of care for licensed tour operators under Icelandic law.

X. SHORE EXCURSIONS

Shore Iceland reserves the right to cancel or amend any excursion due to adverse weather, safety issues, or other necessary reasons. In such cases, clients will receive a refund according to the following policy:

  1. If the tour is canceled due to a ship delay or the vessel’s inability to dock up to 24 hours before departure, a refund will be issued minus a 5% processing fee to cover transaction costs.
  2. If the cancellation occurs between 24 and 3 hours before departure, 85% of the payment will be refunded.
  3. If the cancellation occurs between 3 hours and 30 minutes before departure, 80% will be refunded.
  4. Cancellations by participants less than 24 hours before departure are non-refundable, even if followed by changes in ship arrival or port access.
  5. Participants must request refunds within 14 days of the excursion date. Guests who choose not to participate due to weather conditions, or who leave the designated transportation during the tour, are not eligible for refunds and must arrange their return to the vessel at their own expense.
  6. If a cruise ship arrives late, the tour will proceed in a shortened format to accommodate the ship’s schedule. This adjustment does not constitute grounds for partial refunds or compensation. Likewise, if severe weather develops during the excursion, Shore Iceland may shorten the route or itinerary for safety reasons.
  7. In the event a participant misses the embarkation of their ship due to independent decisions or delays unrelated to the tour operator, Shore Iceland accepts no liability or responsibility. It is the traveler’s responsibility to arrange return transportation and to carry travel insurance that covers such situations.
  8. Shore Iceland does not accept liability for any injuries, accidents, or losses during a tour, particularly when caused by participants’ own actions or failure to follow guide instructions.

XI. BOOKING ERRORS

Shore Iceland takes all reasonable steps to ensure that booking information, dates, and pricing are accurate. In the rare case that a booking error occurs due to an internal system or administrative issue, the company will notify the customer as soon as possible and reserves the right to amend or cancel the booking. In such cases, a full refund will be issued if the arrangement is canceled by the company.

If a customer makes a booking error — for example, selecting the wrong date, tour, or participant information — the general cancellation terms apply. Customers who wish to correct or cancel such a booking may do so up to 24 hours before the tour starts for a full refund. Cancellations made less than 24 hours before departure are non-refundable.

This approach ensures fairness and compliance with Icelandic consumer law, balancing responsibility between both parties while maintaining transparency in booking operations.

XII. ASSUMED RISK & OUTDOOR ACTIVITIES

Assumed Risk: Refers to the acknowledgment and acceptance of potential hazards and dangers associated with outdoor activities and excursions organized by Shore Iceland.

Outdoor Activities: Refers to any tours, excursions, or activities offered by Shore Iceland that take place outdoors, including but not limited to hiking, trekking, glacier walks, day tours, and other adventure activities.

Participants in outdoor activities organized by Shore Iceland acknowledge and accept the inherent risks and hazards associated with such activities. These risks may include but are not limited to, uneven terrain, terrain challenges, weather conditions, slippery surfaces, inclement weather, wildlife encounters, traffic accidents, and physical exertion.

By choosing to participate in outdoor activities, participants understand that accidents, injuries, or unforeseen events may occur despite the precautions taken by Shore Iceland and its guides. Participants agree to assume all risks associated with the activity and waive any claims against Shore Iceland for injuries, damages, or losses incurred during the activity.

Participants are responsible for ensuring that they are physically and mentally prepared for the challenges posed by outdoor activities. It is recommended that participants follow all safety instructions provided by Shore Iceland guides and use appropriate gear and equipment.

Shore Iceland reserves the right to modify or cancel outdoor activities in the event of adverse weather conditions, safety concerns, or other unforeseen circumstances. Participants will be informed of any changes or cancellations as soon as possible.

XIII. ALCOHOL & DRUGS

Alcohol & Drugs: Refers to the consumption or use of alcoholic beverages and controlled substances, including illegal drugs and prescription medications, that may impair judgment, coordination, or behavior.

Participants in tours, excursions, or activities organized by Shore Iceland are prohibited from consuming alcohol or using drugs before or during the duration of the activity. This policy is in place to ensure the safety of all participants and to maintain a respectful and enjoyable environment for everyone involved.

Alcohol consumption or drug use can impair judgment, coordination, and decision-making abilities, increasing the risk of accidents, injuries, or disruptive behavior. Therefore, participants are expected to refrain from consuming alcohol or using drugs that may impair their ability to safely participate in the activity.

Any participant found to be under the influence of alcohol or drugs during the activity may be asked to leave the tour or excursion at the discretion of Shore Iceland guides or staff. No refunds will be provided for participants who are removed from the activity due to violation of this policy.

Participants are responsible for ensuring that they are not under the influence of alcohol or drugs at the start of the activity. It is recommended that participants refrain from consuming alcohol or using drugs in the hours leading up to the activity to ensure their full participation and enjoyment.

This measure is essential for maintaining a safe and enjoyable experience for everyone involved and minimizing the risk of accidents or disruptive behavior.
